About Me

I have learned and understood Trademark Law by myself for almost 30 years. From filing and submitting my IP applications to mediating and responding to office actions for the USPTO attorneys and commencing infringement lawsuits on a federal or state level, I have first-hand experienced the tedious affairs of Intellectual Property Law.

I have had many conflicts understanding these endeavors and getting the hang of them at first, which made me realize that these affairs are a pain to experience for many people due to their intricate nature. Therefore, the premise of this website was set by my intent to educate and assist those who have difficulties understanding these complex matters.

The Procedure Of

Intellectual Property Rights Registration

Below are the steps required to register yourself for IPR protection laws. Note that these laws differ based on the type of protection.

Trademark Registration

Determining your type of protection

You will need to determine what sort of protection you need. Depending on the nature of your work, it could be Trademark, Copyright, or Patent protection.

01

Get Ready to Apply

You need to prepare for the application process. First, you need to conduct a thorough search for your desired trademark availability. To pass the application, your trademark needs to be unique and distinguishable from similar or identical pre-existing trademarks.

02

Accumulate Documents & Apply

After researching and accumulating the required documentation, you will be prompted to log in to your USPTO.gov account and file an application for trademark registration.

03

Working with Assigned USPTO Examining Attorney

After reviewing your application, a dedicated USPTO Examining Attorney may mark your application or trademark unfit and send you Office Actions (official letters regarding any issues with your Trademark or the application itself). Timely response to these office actions is compulsory.

04

Application Approval/Denial

Upon thorough examination and finalization of your application, the assigned examining attorney will label the application approved or denied. Both cases have several factors that directly influence which of them would be the outcome.

05

Maintain Registration

Once your registration is live, you need to maintain it by providing specific registration maintenance documents within the designated time. Failure to do so will result in the cancellation of your protection trademark.
